Tariff Updates

November 10, 2025

Effective today, November 10, 2025, tariff rates on imported fireworks from China have reduced to:

  • 25.3% for 1.4G consumer fireworks
  • 22.4% for 1.3G display fireworks

The NFA/APA Tariff Team is continuing to coordinate outreach with champions for our industry, and we have not slowed down our fight.

Yesterday, two of NFA's partners at TAG Consulting Group in Washington, D.C., had the opportunity to attend the U.S. Supreme Court hearing regarding the legality of global tariffs imposed under presidential emergency powers. This case has major implications for the American fireworks industry and our ongoing efforts to ensure the availability and affordability of fireworks for everyone—especially as we prepare to celebrate the 250th anniversary of the United States.

Key Updates:

  • Supreme Court Hearing – November 5: The Court heard arguments on whether the tariffs imposed under the 1977 International Emergency Economic Powers Act (IEEPA) exceed presidential authority. Several justices—Chief Justice John Roberts and Associate Justices Neil Gorsuch and Amy Coney Barrett—voiced skepticism about the scope of these powers, suggesting that tariff-setting authority may rest constitutionally with Congress.

  • Potential Impact: A decision limiting the president’s authority could reshape tariff policy and directly affect the ongoing fireworks tariff situation. All three lower courts that reviewed similar cases have ruled the tariffs unlawful, and today’s arguments indicate the Supreme Court may take a close look at the limits of executive power.

  • NFA Engagement:

  • Last week, NFA submitted an updated letter to President Trump and copying both the Secretary of the Treasury and USTR Ambassador, outlining our industry’s concerns and formally requesting clarification and tariff relief.

  • Earlier this year, NFA and APA representatives met with the Office of the United States Trade Representative (USTR) to propose a reduction of fireworks tariffs to 10%, supported by detailed HTS code submissions.

  • The current estimated tariff on imported consumer and display fireworks (1.3G/1.4G) remains at approximately 25%, pending official confirmation.

  • Industry Impact: Ongoing tariff uncertainty, compounded by international shipping constraints, is causing delays for importers and jeopardizing the ability of small towns and communities nationwide to host fireworks celebrations.

The NFA’s advocacy team continues to monitor what is happening with tariffs, the Trump Administration, and what transpired at the Supreme Court.  We will keep you informed as developments unfold. The National Fireworks Association continues to closely monitor the evolving tariff situation as it directly impacts every segment of our industry. Below is the latest information as of October 22, 2025.

Current Status

     The current tariff on imported fireworks from China remains at 30%, under the temporary 90-day pause that began in August.

     This pause is set to expire in the second week of November, and without new agreements, tariffs could increase substantially.

     The Office of the U.S. Trade Representative (USTR) has requested and received all materials from the NFA, including our industry offer and HTS code submissions for fireworks products.

     The NFA Tariff Team continues coordinated outreach with our 250 coalition chairs and congressional champions, ensuring our industry’s voice remains strong and visible in Washington.

Upcoming Events & Key Dates

     President Trump and President Xi Jinping are expected to meet at the Asia-Pacific Economic Summit in South Korea this weekend, where trade and tariff policy are expected to be major discussion points.

     The U.S. Supreme Court hearing related to Section 301 tariff actions is scheduled for November 5, with two NFA lobbyists in attendance.

     President Trump has indicated he plans to attend the hearing, underscoring the national attention on this issue.

Potential Developments

     The administration has publicly threatened an additional 100% tariff on Chinese imports if no progress is achieved during the summit or subsequent negotiations.

     While certain product exclusions have been extended by USTR through November 29, fireworks are not currently included in those exemptions.

     The NFA continues to advocate for industry-specific relief, highlighting that over 99% of consumer fireworks and 90% of display fireworks are manufactured in China — making domestic substitution impossible in the short term.

NFA Advocacy & Next Steps

     The NFA Tariff Task Force will continue active engagement with federal agencies and key policymakers.

     Coalition chairs and members are encouraged to maintain open communication with their representatives, emphasizing the economic, cultural, and patriotic importance of the fireworks industry.

     NFA leadership is prepared to respond quickly following the upcoming summit and Supreme Court proceedings, depending on the direction of U.S.–China trade discussions.

Looking Toward America’s 250th Anniversary

As our nation prepares to celebrate its 250th anniversary in 2026, it is more important than ever to ensure clarity and stability within our industry. Fireworks are an enduring symbol of American freedom and celebration — and our ability to provide safe, affordable, and spectacular displays depends on resolving these trade uncertainties now. The NFA remains committed to protecting this proud tradition for communities across the country as we approach this historic milestone. 

A letter will be sent soon to America250.org asking that they engage on the tariff issue before it is too late.

The NFA continues to actively represent the interests of the fireworks industry during this critical time. We remain cautiously optimistic that continued dialogue between the United States and China will lead to a resolution that avoids devastating tariff increases.

The National Fireworks Association is aware that President Trump has threatened to place an additional 100% tariff on most imports coming from China by or before November 1st, 2025.  Although the White House has not put out any guidance or confirmation of this action, the NFA - in conjunction with the collaborative Tariff Team - is actively seeking clarification and answers as to how & when this situation will effect our members.  As soon as we have confirmed and factual information, we will share it with the membership.  The earliest we expect to have an update is Tuesday, October 14th, but we will certainly provide any additional details as soon as we receive them.  If we learned anything from the fallout of Liberation Day in April, it is that things change fast and the coming days & weeks will likely be unpredictable.
