NFA's Stance on the First Sale Rule
February 3, 2026The National Fireworks Association continues to closely monitor developments related to the Section 301 tariffs and the ongoing legal challenges impacting our industry. Over the past year, members have faced multiple and fluctuating tariff layers and duty rate increases, which in many cases have resulted in combined effective duty rates exceeding 30% and at times, significantly higher. We recognize these cumulative tariff burdens have created significant financial strain for many of our members, particularly small and mid-sized businesses, and we want to provide clarity on where things currently stand and what steps members may consider taking. At this time, NFA is not associated with or participating in any legal actions, including the IEEPA-related lawsuits currently moving through the courts. While we are in communication with various stakeholders and advisors, there is no NFA-sponsored or NFA-endorsed mass-joinder or “me-too” lawsuit available for members at this point. The NFA/APA Tariff Task Force is planning a fly-in to Washington, D.C. once the Supreme Court is back in session, and we remain actively engaged with policymakers and agency officials. Additionally, we have reached out to our contacts at the Office of the U.S. Trade Representative (USTR) seeking further clarification specific to the fireworks industry and are awaiting a response. Any meaningful guidance received will be shared with the membership promptly. While NFA cannot provide legal advice or referrals, we want to highlight several practical steps members may wish to discuss with their customs broker or trade counsel. January 15, 2026At this time, there has been no action or announcement from the Supreme Court related to current trade or tariff matters that would directly impact our industry. While several cases with broader trade implications are being closely watched, none have produced a ruling or guidance affecting fireworks imports as of today. Additionally, regarding questions around a potential 25% tariff connected to the evolving Iran situation, our team has reached out to the Office of the U.S. Trade Representative (USTR) seeking clarification. To date, we have not received a response. The absence of communication from brokers or official guidance from federal agencies further underscores the uncertainty and lack of definitive information at this time. If implemented, any new or expanded tariff could have significant implications for the fireworks industry, including increased landed costs, supply chain disruption, and pricing pressure during an already compressed and seasonal sales cycle. As members are aware, fireworks procurement occurs months in advance, and sudden policy shifts can have outsized impacts on inventory already in transit or contracted. Please know that we are monitoring this situation very closely. The Tariff Team remains actively engaged with our federal contacts and industry partners and will continue to press for clarity on behalf of the membership. November 6, 2025Yesterday, two of NFA's partners at TAG Consulting Group in Washington, D.C., had the opportunity to attend the U.S. Supreme Court hearing regarding the legality of global tariffs imposed under presidential emergency powers. This case has major implications for the American fireworks industry and our ongoing efforts to ensure the availability and affordability of fireworks for everyone—especially as we prepare to celebrate the 250th anniversary of the United States. The National Fireworks Association continues to closely monitor the evolving tariff situation as it directly impacts every segment of our industry. Below is the latest information as of October 22, 2025. Current Status ● The current tariff on imported fireworks from China remains at 30%, under the temporary 90-day pause that began in August. ● This pause is set to expire in the second week of November, and without new agreements, tariffs could increase substantially. ● The Office of the U.S. Trade Representative (USTR) has requested and received all materials from the NFA, including our industry offer and HTS code submissions for fireworks products. ● The NFA Tariff Team continues coordinated outreach with our 250 coalition chairs and congressional champions, ensuring our industry’s voice remains strong and visible in Washington. Upcoming Events & Key Dates ● President Trump and President Xi Jinping are expected to meet at the Asia-Pacific Economic Summit in South Korea this weekend, where trade and tariff policy are expected to be major discussion points. ● The U.S. Supreme Court hearing related to Section 301 tariff actions is scheduled for November 5, with two NFA lobbyists in attendance. ● President Trump has indicated he plans to attend the hearing, underscoring the national attention on this issue. Potential Developments ● The administration has publicly threatened an additional 100% tariff on Chinese imports if no progress is achieved during the summit or subsequent negotiations. ● While certain product exclusions have been extended by USTR through November 29, fireworks are not currently included in those exemptions. ● The NFA continues to advocate for industry-specific relief, highlighting that over 99% of consumer fireworks and 90% of display fireworks are manufactured in China — making domestic substitution impossible in the short term. October 11, 2025The National Fireworks Association is aware that President Trump has threatened to place an additional 100% tariff on most imports coming from China by or before November 1st, 2025. Although the White House has not put out any guidance or confirmation of this action, the NFA - in conjunction with the collaborative Tariff Team - is actively seeking clarification and answers as to how & when this situation will effect our members. As soon as we have confirmed and factual information, we will share it with the membership. The earliest we expect to have an update is Tuesday, October 14th, but we will certainly provide any additional details as soon as we receive them. If we learned anything from the fallout of Liberation Day in April, it is that things change fast and the coming days & weeks will likely be unpredictable.
